Can foreigners own property in Thailand? +
Foreigners cannot own land outright in Thailand but can own condominium units (up to 49% of a building’s floor area) in their own name. For houses and villas, options include long-term leasehold structures (up to 30 years, renewable), Thai company ownership, or usufruct arrangements. We explain all options in your free consultation and recommend what’s appropriate for your situation.
What does due diligence actually cover? +
Our due diligence covers: title deed verification at the Land Office, check for mortgages, liens, and encumbrances, confirmation that the seller holds legal title and has the right to sell, zoning verification, building permit checks (where applicable), and a review of any HOA or juristic person obligations attached to the property. You receive a written report of our findings.
What if the due diligence finds a problem? +
We present you with the findings clearly and explain your options — which may include walking away, renegotiating the price, or requiring the seller to resolve the issue before transfer. The decision is always yours. We never pressure you to proceed.
Can you help if I’m buying from a developer off-plan? +
Absolutely — and off-plan purchases carry additional risks (developer insolvency, delayed handover, specification changes) that make legal protection even more important. We review the developer’s track record, the reservation and sale-purchase agreements, and ensure your deposit is protected with appropriate clauses.
Do I need to be physically present for all steps? +
Much of the process — due diligence, contract review, and negotiation — can be handled remotely. You do need to be present in Thailand for the Land Office transfer, or you can grant us power of attorney to act on your behalf. We’ll advise you on the most practical approach for your situation.
How early in the process should I contact you? +
